Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and DATASHOP SOLUTIONS ("Nifty", "we", "us", or "our") governing your use of the Nifty browser extensions, website, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.

Nifty provides browser extension tools that enable users to extract publicly available data from websites. Our Services include:

• Web scraping browser extensions for Chrome and Firefox
• Data export functionality in various formats (CSV, Excel, JSON, etc.)
• Add-ons for extended functionality
• Custom scraper development services

All data scraping and processing occurs locally within your browser. We do not access, store, or process the data you scrape.

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Accept responsibility for all activities under your account

We offer the following subscription tiers:

• Free: Limited exports per day and rows per export
• Unlimited: $9.99/month - Unlimited usage for one scraper
• Enterprise: $49.99/month - Access to all scrapers

Prices are subject to change with reasonable notice. Current subscribers will be notified of any price changes before their next billing cycle.

Billing: Paid subscriptions are billed monthly in advance. Payment is processed through our payment provider, Polar.

Cancellation: You may cancel your subscription at any time. Upon cancellation:

• You will retain access to paid features until the end of your current billing period
• Your account will revert to the Free tier after the billing period ends
• No partial refunds are provided for unused time within a billing period

We offer refunds under the following conditions:

• Refund requests must be made within 14 days of your most recent payment
• Only the most recent payment is eligible for refund
• Refunds are processed to the original payment method

To request a refund, contact us at hello@nifty.codes with your account email and reason for the request.

Nifty provides tools for data extraction. You are solely responsible for how you use these tools and the data you collect. By using our Services, you agree to:

• Comply with all applicable laws and regulations in your jurisdiction
• Respect the terms of service of any websites you scrape
• Not use scraped data in ways that violate privacy laws or regulations
• Not use our Services for any illegal, harmful, or malicious purposes
• Not attempt to circumvent technical limitations or security measures

We do not monitor, control, or take responsibility for how you use the data you extract. You assume all risk and liability associated with your use of scraped data.

You agree not to use our Services to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Harvest personal data for unsolicited communications (spam)
• Interfere with or disrupt target websites' operations
• Resell or redistribute our Services without authorization
• Reverse engineer, decompile, or attempt to extract the source code of our extensions

In addition to our subscription-based Services, we offer custom scraper and custom add-on development ("Custom Services"). The following terms apply to all Custom Services:

Scope and Pricing: Each custom project begins with a consultation where we agree on the scope, deliverables, and pricing. The agreed-upon scope is documented before work begins. Minor adjustments during development are accommodated at our discretion; significant changes beyond the original scope require a new quote and separate agreement.

Payment: Payment for Custom Services is due in full upon completion, after the deliverable has been tested and confirmed functional. All payments for Custom Services are final and non-refundable.

Intellectual Property: All custom-built scrapers and add-ons remain the intellectual property of DATASHOP SOLUTIONS. Upon full payment, we grant you a non-exclusive, non-transferable license to use the deliverable within your organization. You may not resell, redistribute, sublicense, or share the deliverable with any third party outside your organization.

Maintenance Guarantee: We provide a 6-month maintenance period from the date of delivery for all Custom Services. During this period, we will:

• Fix bugs and issues that arise from normal use
• Make minor updates such as adding or removing fields
• Address breakages caused by changes to target website structures, where reasonably possible

Post-Guarantee Period: After the 6-month maintenance period, we have no obligation to maintain or update the deliverable. However:

• We may address minor issues on a best-effort basis at no charge
• Major fixes and updates are available on a paid, case-by-case basis

No Guarantee of Continued Operation: Custom scrapers and add-ons interact with third-party websites that may change their structure, implement anti-scraping measures, or become unavailable at any time. We do not guarantee that any custom deliverable will function indefinitely, even during the maintenance period, if the underlying target website makes changes that render scraping infeasible.

All content, features, and functionality of our Services, including but not limited to software, text, graphics, and logos, are owned by DATASHOP SOLUTIONS and are protected by intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable license to use our Services for their intended purpose.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• Our Services will be uninterrupted, error-free, or secure
• Our scrapers will work with all websites or continue to work if target websites change their structure
• The data you extract will be accurate, complete, or suitable for your purposes
• Our Services will meet your specific requirements

Website structures change frequently. While we strive to maintain our scrapers, we cannot guarantee compatibility with any specific website at any time.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATASHOP SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or business opportunities
• Damages resulting from your use or inability to use our Services
• Damages resulting from unauthorized access to your account
• Any claims arising from your use of scraped data
• Any legal action taken against you by third parties related to your use of our Services

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless DATASHOP SOLUTIONS and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of any rights of third parties
• Your use or misuse of scraped data

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause or notice, including for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• At our sole discretion for any reason

Upon termination, your right to use our Services will immediately cease. Sections of these Terms that by their nature should survive termination will survive.

Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration in accordance with the arbitration rules of the jurisdiction of Bahrain.

You agree to attempt to resolve any dispute informally by contacting us at hello@nifty.codes before initiating arbitration.

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Bahrain, without regard to its conflict of law provisions.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms on our website
• Updating the "Last updated" date
• Sending an email notification for significant changes

Your continued use of our Services after changes constitutes acceptance of the modified Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DATASHOP SOLUTIONS regarding your use of our Services and supersede any prior agreements.
